Heard Sri Krishan Mohan Mishra, learned counsel for the petitioners, learned AGA for the respondents-State and perused the record.
This petition for writ under Article 226 of Constitution of India is preferred with a prayer to quash the first information report dated 6.12.2017 bearing Case Crime No. 310 of 2015 pending investigation at Police Station - Civil Lines, District - Allahabad pertaining to offence punishable under Sections 419, 420, 467, 468, 471 IPC.
Learned counsel for the petitioners submits that no case is made out against the petitioners for the offence referred in the first information report.
From perusal of the facts stated in the first information report, it is apparent that the order of appointment of the petitioners is alleged to be forged and the petitioners themselves claimed appointment on that basis. The other contents of the first information report also discloses the allegations pertaining to commission of serious offence cognizable and that in no manner warrants interfere under Article 226 of the Constitution of India. Further no case for staying the arrest of the petitioners too is made out.
The writ petition is dismissed.
