By way of instant appeal, challenge has been made to the validity and sustainability of the judgment and order of conviction dated 20.03.2002 passed by Special Judge (Anti Corruption) Varanasi, in Special Trial No.134 of 1997, State Vs. Rajendra Pratap Singh, under Section 7 of P.C. Act and under Section 13(2) of the P.C. Act, Police Station Chandwak, District Jaunpur, whereby convicting appellant to undergo two years R,I. and to pay a fine of Rs.5000 for offence and under section 7 Prevention of Corruption Act in default of payment of fine to undergo six months simple imprisonment and undergo 4 years R.I. and fine of Rs. 5000/- and default of payment of fine to undergo one year simple imprisonment for offence under section 13(2) of the P.C. Both sentence to run concurrently.
Vide letter dated 22.10.2018 of learned Chief Judicial Magistrate, Jaunpur, it has been intimated that Rajendra Pratap Singh, sole appellant of this case has been expired on 19.02.2016.
In view of above, this appeal is liable to be dismissed as abated.
The present appeal is, accordingly, dismissed as abated.
