On the matter being taken up today, no one appears on behalf of the appellant.
Heard learned AGA for the State and perused the record.
The present appeal has been preferred against the judgment and order of conviction dated 02.03.1987 passed by the Special Judge (DAA), Hamirpur, in Special Case No.189 of 1985 under Section 395 IPC whereby the appellant has been sentenced to undergo five years rigorous imprisonment under Section 395 IPC.
Vide intimation/letter of the Chief Judicial Magistrate, Hamirpur, dated 06.02.2018, it has been disclosed that the sole appellant Ganesh has died 15 years back.
In view of above, obviously the sole appellant has died, therefore, the instant appeal abates and is dismissed as abated.
