Heard learned counsel for the applicant, learned A.G.A for the State and perused the material available on record.

At the time of hearing learned A.G.A, Sri D.N. Tiwari, submitted that in this case notice was issued to the informant Sri Parashuram, who as per information has been personally served. However, no one appeared to oppose the appeal.

Learned counsel for the applicant has contended that the applicant has falsely been implicated in the present case. The injury has been caused on the person of the accused side, copy of the injury report is annexed as annexure no. 2, in which no injury mark has been seen. The allegations against the applicant have been made due to village enmity and there is no motive to commit the offence. The applicant does not bear any criminal history and is languishing in jail since 20.07.2018.

Learned AGA has opposed prayer for bail. However, learned AGA has not disputed the aforesaid facts.

Without expressing any opinion on merits of the case but considering the facts and circumstances of the case, nature of accusation and the severity of punishment in case of conviction and the nature of supporting evidence, reasonable apprehension of tampering with witness or apprehension of threat to the complainant and prima-facie satisfaction of the Court in support of the charge, the applicant is entitled to be released on bail. Accordingly, bail application is allowed .
