Perused the impugned judgment and order and heard learned AGA for the State.
The appellant- Ram Sajiwan has filed this appeal against the judgment and order dated 05.04.2005 passed by Additional Sessions Judge, Banda in S.T. No. 139/2001 (State of U.P. Vs. Ram Sajiwan), Police Station- Kotwali Nagar, District Banda whereby the appellant has been convicted under Section 306 I.P.C. and sentenced to imprisonment for four years coupled with fine of Rs. 5000/- with default stipulation, he will have to undergo additional three months imprisonment. Report of C.J.M.- Banda which was received by fax in the office available on record on this appeal indicates that Ram Sajiwan, sole accused appellant in this appeal has died five years ago i.e. 27.02.2013.
In view of above, this appeal stands abated.
The appeal is accordingly dismissed.
