Heard learned counsel for the applicant and Shri P.K. Giri, the learned Additional Chief Standing Counsel.
Shri Giri has placed on the record an order dated 23 May 2018 passed by the District Magistrate, Basti which is marked as 'X' for the purposes of identification.
From the said order, the Court notes that the claim of the applicant Nos. 1 and 2 has been rejected on merits.
Insofar as the applicant No.3 is concerned, although the opposite party does not dispute his eligibility and inclusion of his name in the data base, it is stated that the persons upto Sl. No.13 have been allotted houses and that the case of the applicant No.3 shall also be considered in due course and in accordance with his position in the concerned data base.
The claim of the applicant No.4 has been denied on the ground that his name was not included in the data base.
Consequently nothing further survives on this petition which shall stand disposed of. This order however shall not preclude the applicant Nos. 1, 2 & 4, if so chosen and advised, to initiate appropriate proceedings in respect of the order dated 23 May 2018.
