From the instructions produced today, the opposite parties take the stand that all encroachments existing on the Nali in question have been removed. The contention of the learned counsel that the Nali has been dug on his agricultural plot, cannot be countenanced since this even remotely did not form subject matter of the writ petition.
The petition is dismissed .
