Counter affidavit filed on behalf of learned A.G.A. for the State is taken on record.

Heard learned counsel for the applicant, learned AGA for the State and perused the material brought on record.

This bail application has been moved by the applicant-Ravi Chikwa who is involved in Case Crime No.406 of 2017, under Sections 302, 201 IPC, Police Station-Auraiya, District-Auraiya.

As per prosecution version, on 19.5.2017, a decomposed dead-body of a person was recovered by the police. Later on, on 21.5.2017, informantSmt. Vimla Devi identified that the dead body is of her dewar -Ramdas. On the basis of Forensic Science Laboratory report, the deceased was died due to deep head injury before ten days of recovery of the dead-body. During investigation, it came into light that applicant-Ravi Chikwa along with other co-accused Smt. Meera Devi wife of deceased and Neetu daughter of deceased caused the murder of Ramdas.

Learned counsel for the applicant contended that only on the basis of confessional statements of applicant and co-accused Meera Devi before the police, applicant has been made an accused in this case. Applicant has no criminal history and is languishing in jail since 03.08.2017.

Learned A.G.A. has opposed the prayer for bail and contended that there is evidence of illicit relation of applicant with the daughter of the deceased but admitted this fact that there is no direct or last seen evidence against the applicant.

Having heard the submissions of learned counsel of both sides, considering the facts and circumstances of the case and without expressing any view on the merit of the case, I deem it proper to enlarge the applicant on bail.

Let applicant-Ravi Chikwa be released on bail in Case Crime No.406 of 2017, under Sections 302, 201 IPC, Police Station-Auraiya, DistrictAuraiya, on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the C.J.M./Magistrate concerned.
