Heard Sri Ravi Prakash Singh, learned counsel for the applicant and Sri Purushottam Maurya, learned A.G.A. appearing for the State.
Learned counsel for the applicant in support of his prayer for bail submits that the applicant is innocent and he has been falsely implicated in the present case on 11.10.2017. It is further submitted that applicant has not committed any robbery. It is further submitted that no recovery in the said case was made from the possession of the applicant and whatever has been recovered from the possession of the applicant has no relation with the applicant. It is further submitted that applicant has two cases of criminal history which has been properly explained in para 14 of the affidavit. The applicant is in jail since 11.10.2017.
Learned A.G.A. opposed the prayer for bail.
Considering the nature of accusation and the severity of punishment in case of conviction and the nature of supporting evidence, reasonable apprehension of tempering of the witnesses and prima facie satisfaction of the Court in support of the charge, the applicant is entitled to be released on bail in this case.
