Heard learned counsel for the applicant, Sri Gopal Chaturvedi and Sri Sudist, learned counsel for the informant and Sri Ratnendu Kumar Singh learned A.G.A.
This bail application is filed on behalf of the applicant involved in Case Crime No. 399 of 2010, under Sections 302, 307, 120-B/34 I.P.C. and Section 7 of Criminal Law Amendment Act, P.S. Tola, District Mau.
After arguing the matter at length, learned counsel for the parties inform that the trial is at final stage; applicant is languishing in jail since 22.06.2010; role of conspiracy has been assigned to the applicant; all other co-accused of conspiracy have already been enlarged on bail except the applicant; the prosecution witnesses have not supported the theory of conspiracy; applicant is entitled to be enlarged on bail.
In the circumstances, I am not inclined to entertain the bail application at this stage, however, it is open to the applicant to make an appropriate bail application before the trial court, if he so desires.
