Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.

This bail application has been moved by the accused-applicant Jameel, who is involved in Case Crime No. 0140 of 2018, under Sections 147, 302, 323, 506 IPC, Police Station - Shikarpur, District - Bulandshahar.

It is contended by learned counsel for the applicant that F.I.R. has been lodged after 12 hours of the occurrence. There is single injury to the deceased Sakir. The role of causing injury is assigned to five persons. Moreover, similarly placed co-accused Meena and Hassan Alias Hasan, whose case is on equal footing to that of the applicant, have been admitted to bail vide order passed in Criminal Misc. Bail Application No. 41047 of 2018 dated 01.11.2018 and Criminal Misc. Bail Application No. 45294 of 2018 dated 05.12.2018 respectively. Hence, the present applicant is also entitled to be admitted to bail on the ground of parity. He further contended that the applicant has no criminal antecedents and is languishing in jail since 17.05.2018.

Per contra, learned A.G.A. has opposed the prayer for bail. However, admitted this fact that role of applicant is similar to that of co-accused Meena and Hassan Alias Hasan.

Considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail. Let the applicant- Jameel , be released on bail in the aforesaid case crime number on his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the C.J.M./Magistrate, concerned.

Application stands allowed.
