Heard learned counsel for the applicant, learned A.G.A. and perused the record.

This bail application has been moved by the applicant Janki who is involved in Case Crime No. 427 of 2006, under Sections 147, 148, 149, 307, 302, 504, 506 I.P.C., Police Station - Gunnaur, District - Badaun (Sambhal).

Learned counsel for the applicant contended that applicant was summoned with other co-accused Jaiveer and Ram Kumar under Section 319 Cr.P.C. Police has submitted final report against the applicant. The arrest of applicant and co-accused Jaiveer and Ram Kumar was stayed by order dated 19.11.2018 passed by this Court in Criminal Revision No. 3427 of 2018 (Jaiveer and Others Vs. State of U.P. and Another). Arrest of applicant and co-accused was stayed but before this order, on 26.09.2018 applicant was arrested by the police. Police has submitted charge sheet against other co-accused who have already been enlarged on bail by order of Session Court.

Learned A.G.A. has opposed the prayer for bail.

Considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail. Let the applicant- Janki, be released on bail in the aforesaid case crime number on his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the Court concerned.

Application stands allowed.
