Heard learned counsel for the applicant as well as learned AGA for the State and perused the material placed on record.

It is argued by the learned counsel for the applicant that the applicant is absolutely innocent and has been falsely implicated in the present case with some ulterior motive. The applicant is languishing in jail since 15.02.2018. He does not have any criminal history to his credit. In case, the applicant is released on bail he will not misuse the liberty of bail. It is further submitted by the learned counsel for the applicant that similarly placed co-accused Gappu alias Ramraksha Pal has been granted bail by co-ordinate Bench of this Court vide order dated 21.05.2018 in Criminal Misc. Bail Application No. 18825 of 2018. On the ground of parity the applicant is also entitled to be released on bail.

Per contra learned A.G.A. has opposed the bail prayer of the applicant, but could not dispute the aforesaid fact.

Having considered the submissions of the parties and without expressing any opinion on the merits, let the applicant Naresh, involved in case crime No. 17 of 2018, under sections 302, 201 IPC, PS Faizganj Behta, District Budaun, be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned with the following conditions that :-
