The submission of the learned counsel for the applicant is that he has been implicated in the present crime on account of a dispute over patrimony between two sisters. The applicant's wife and the prosecutrix are sisters. It is submitted that the father of the prosecutrix and the applicant's wife gave away all his property by a bequest to the applicant's wife on account of the fact that his other daughter, the prosecutrix, eloped with a man of her choice against the father's wishes. Now, the prosecutrix, at the behest of her husband, the man with whom she eloped, to the annoyance of her father has caused the present FIR to be lodged against the applicant, who is the husband of the prosecutrix's sister, the beneficiary of her father's bequest. It is submitted that the prosecution is motivated by issues over entitlement to patrimony, of which the prosecutrix has been deprived. It is emphasized that a reading of the statement under Section 164 Cr.P.C. makes it sound preposterous that a wife would lock up her husband in a room asking him to ravish her sister. It is submitted that the allegation is unnatural and illogical; on the other hand, it is consistent with a case of false implication with the background of dispute that is there between the two sisters over division of property.
