Heard learned counsel for the applicant as well as learned AGA for the State of U.P and perused the material available on record.
The applicant tenders final pardon from this Court as a measure of last chance that he will participate in the on going proceeding of the trial and would not cause any delay in disposal of the same, if he is given one last chance by admitting him to bail. The applicant is languishing in jail since 9.7.2018. In case the applicant is released on bail there is no possibility of his absconding or misusing the liberty of bail.
Learned A.G.A. has vehemently opposed prayer for bail that prior to this bail application, the applicant has made several promises, but have worked against his promise and violated his own promise.
Considered the submissions.
The interest of justice demands that the applicant of his own saying, should be admitted to bail provided he shall remain present on each date and will co-operate in the proceeding of the trial court and in case proceedings are held up because of the act of applicant, the court below shall be free to pass appropriate order.
Accordingly, bail application is allowed.
Let the applicant - Dinesh Yadav involved in Case Crime No.219 of 2009 under Sections - 392 I.P.C., Police Station - Bela, District - Auraiya be released on bail on his executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
