Learned counsel for the applicant submits that applicant is innocent and has not been named in the First Information Report. First Information Report was lodged on 25.5.2018 after the incident occurred on 20.5.2018. The FIR was lodged by Rajpal, father of the deceased Umesh, when he disappeared and did not return from Delhi to Hapur, where he used to work for livelihood. When the informant asked Neelam, wife of deceased Umesh regarding his whereabouts, she told that she had a telephonic conversation with her husband, who informed her that he will reach home in a short while. On 21.5.2018, when the whereabouts of Umesh could not be known, the informant lodged missing report on 21.5.2018 at Kotwali Hapur regarding disappearance of Umesh. On 23.5.2018 it was telephonically informed at Police StationBabugarh that the dead body of Umesh was lying near Bachlota Canal, then nephew and son of the informant along with others went to Police Station-Babugarh, but Neelam did not accompany them. The dead body was recognised as that of Umesh and after the post-mortem examination of the deceased, last rites were performed. It was came to the knowledge of the informant that Neelam is acting under suspicious circumstances and she has developed some affair with one Rajan s/o Rajendra @ Kalwa Balmiki, resident of Village-Sabli and she used to talk to and used to meet him all the times. Apprehension was expressed in the FIR that Neelam and Rajan have entered into some conspiracy and have killed Umesh, his son.
