Heard learned counsel for the applicant, learned A.G.A. for State and perused the record.
As per prosecution version, on 18.09.2016 at about 4:00 p.m. accused-applicant assaulted the complainant Smt. Ashoka Devi.
Learned counsel for the applicant contended that applicant has been falsely implicated in the present case. Complainant/injured Smt. Ashoka Devi was medically examined after five days of occurrence. She has sustained no grievous injury. Her face was not disfigured. Applicant has no other criminal antecedent and he is languishing in jail since 22.09.2016.
Learned A.G.A. opposed the prayer of bail.
Without expressing any opinion on the merits of the case and considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail.
Let the applicant Natthu Lal be released on bail in Case Crime No. 1853/2016, under sections 326, 323, 504 and 506 I.P.C., Police Station- Sungarhi, District Pilibhit on furnishing a personal bond and two sureties in the like amount to the satisfaction of court concerned.
Accordingly, the instant bail application is allowed .
