Learned counsel for the applicant submitted that the applicant is the husband of the deceased. The FIR was registered by the complainant, father of the deceased against four accused persons including the applicant. Initially, the FIR was registered under Section 302, 323 IPC but during investigation it was converted into Section 306 IPC. As per FIR, the marriage of the deceased was solemnized with the applicant wayback about 15-16 years. The allegation is that the deceased was subjected to cruelty and harassment by the applicant in connection with the demand of Rs. two lacs and due to non-fulfilment of the demand, she was maltreated till her death. Learned counsel next submitted that the husband of the deceased was the habitual drinker and after drinking, he used to maltreat her own wife(deceased) and perturbed by the bad habits of heavy drinking and consistent quarrel between husband and wife, she has taken this extreme step by hanging herself. The next contention is that there is a delay of 26 days in lodging the FIR but no plausible explanation has been given in this regard from the side of the complainant. There is no evidence of any abetment of committing suicide, though this is an unfortunate case whereby the husband in the stage of intoxication used to maltreat her own wife. The applicant is languishing in jail since 06.06.2018.
