Heard learned counsel for the applicant, learned A.G.A. and perused the record.

Learned counsel for the applicant contended that there are seven cases shown in the gang chart against the applicant, and in all cases the applicant is on bail, the bail orders are collectively filed at Annexure No. 4 to the affidavit. Coaccused Vishnu Yadav has been granted bail by this Court vide order dated 15.12.2017, passed in Criminal Misc. Bail Application No. 49317/2017, copy of which has been filed at Annexure No. 5. Applicant has no other criminal history and applicant undertakes that he will not misuse the liberty of bail. Applicant is in custody since 09.12.2016.

Learned A.G.A. opposed the prayer of bail.

There is no evidence on record to show that the applicant was indulged in activity with violence or threat or show of violence, or intimidation, or coercion and that activity has been done with the object of disturbing public order or of gaining any undue temporal, pecuniary, material or other advantage for himself or any other person.

Considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail.

Let the applicant Yogesh Raj Kishore Gaur be released on bail in Case Crime No. 381/2017, under section 2/3 of U.P. Gangster and Anti Social Activities (Prevention) Act 1986, P.S. Mursan, District Hathras on furnishing a personal bond and two sureties each in the like amount to the satisfaction of magistrate/court concerned.
