Heard learned counsel for the applicant and learned A.G.A. for the State and perused the record.

The argument is that the victim is aged about 17 years and she has refused to get herself medically examined. The applicant is languishing in jail since 19.03.2018. He does not have any criminal history to his credit. In case the applicant is released on bail he will not misuse the liberty of bail.

On the other hand learned A.G.A. opposed the prayer for bail.

Without expressing any opinion on the merits of the case and considering the facts and circumstances of the case, I am of the opinion that the applicant is entitled to be released on bail.

Let the applicant Pankaj be released on bail in Case Crime No. 0021 of 2018, under Sections 363, 366, 376 I.P.C and under Section 7, 8 POCSO Act, Police Station Nai Ki Mandi, District Agra on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned with the following conditions which are being imposed in the interest of justice :-
