Heard Sri S.K. Srivastava, learned counsel for the applicant, Sri Ajay Singh, learned counsel for the complainant and Sri Amit Singh Chauhan, learned A.G.A. for the State and perused the record.
It has been contended by the learned counsel for the applicant that the F.I.R. of the present case has been lodged against the applicant only on account of suspicion. He submits that the deceased was having an insurance policy in his name and he was having some dispute with respect to the same with the informant. It appears that due to the said dispute, the informant killed the deceased and falsely implicated the applicant in the present case. The applicant is in jail since 20.12.2017.
Learned counsel for the complainant as well as learned A.G.A. have vehemently opposed the prayer for bail and submitted that the applicant was having some illicit relation with the wife of the deceased. During the course of investigation on the basis of C.D.R., the location of the applicant was found near the place of incident. It is submitted that though the case is of the year 2016 but the applicant had surrendered on 20.12.2017 when the proceedings under sections 82 and 83 Cr.P.C. have been initiated against him.
