Heard learned counsel for the applicant, learned counsel for the complainant and learned A.G.A. for the State.
According to the prosecution case the F.I.R. was lodged against five accused persons, namely Mohan Singh, Vipin, Pradeep, Ajit and Manoj alleging that on 27.10.2017 they assaulted Hari Prasad and Rajendra Singh; Hari Prasad received grievous injuries, resultantly died.
Learned counsel for the applicant submitted that coaccused namely Mohan Singh has been granted bail by this Court vide order dated 23.4.2018 in Criminal Misc. Bail Application No. 7834 of 2018, since the role of the applicant is not distinguishable with the role of co-accused, therefore, the applicant is also entitled for bail. The applicant has been falsely implicated in the present case; there is cross version in F.I.R. No.1105 of 2017, including sections 307, 354, 452 I.P.C. against Pawan, Rajendra, Sanjay, Gokul Singh and Banti @ Bakra in which Pradeep, Ajit and Manoj received injuries and these injuries have not been explained by the complainant; in case he is released on bail, he will not misuse the liberty of bail and will cooperate in the trial; he is languishing in jail since 3.4.2018 (more than one and half months) having no criminal history.
