It is submitted by learned counsel for the applicant that co-accused namely Vinod Singh Munna Rajbhar, Ramashre Sahni (Nishad) and Ram Milan Chaurasiya have been granted bail by co-ordinate Bench of this Court vide order dated 16.11.2017, 13.12.2017, 9.4.2018 and 4.4.2018 in Criminal Misc. Bail Application Nos. 44269 of 2018, 48903 of 2018, 12736 of 2018 and 12253 of 2018, since the role of the applicant is not distinguishable with the role of co-accused, therefore, the applicant is also entitled for bail; the applicant is innocent and has been falsely implicated in the present case. Applicant was not named in the F.I.R. The name of the applicant was disclosed by co-accused Mahatam Yadav. His death was an accidental, unintentional and without knowledge of accused. Offences levelled against the applicant are not attracted in the present case. Criminal history of the applicant has been properly explained. He is languishing in jail since 15.07.2017 (about ten months) and in case he is released on bail, he will not misuse the liberty of bail and will cooperate in trial.
