Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.
This bail application has been moved by the accused-applicant Rajendra, who is involved in Case Crime No. 847/2017, under Section 3(1) of U.P. Gangsters Act and Anti-Social Activities (Prevention) Act 1986, Police Station - Bakhira, District - Sant Kabir Nagar.
It is contended by learned counsel for the applicant that there are three cases shown against the applicant in which he is on bail. The bail orders are filed at Annexure Nos. 2 and 4 of this affidavit. The applicant has no other criminal history. The applicant undertakes that he will not misuse the liberty of bail, if the same is granted to him. The applicant is languishing in jail since 29.06.2017.
Per contra, learned A.G.A. has opposed the prayer for bail. However, admitted this fact that only on the basis of Case Crime No. 701/2017, under Sections 3/5/8 Cow Slaughter Act, P.S. Bakhira, Distrcit Sant Kabir Nagar and Case Crime No. 571/2015 under Sections 3/5/8/ Cow Slaughter Act, P.S. Dharmsinghwa, District Sant Kabir Nagar applicant has been implicated in this case. In both cases, applicant is on bail.
