Submission of counsel for the applicant is that according to the medical examination report, the age of the victimgirl is about 18 years and she was a fully grown up major girl at the time of incident. Attention was drawn to the statement of the victim-girl given before the Magistrate under Section 164 of the Code of Criminal Procedure in which she admitted to have been in love with the applicant and also admitted to have gone along with the applicant on her own volition. She also admitted that she had contracted marriage with him wilfully. She also expressed her desire to live with the applicant and she denied the allegations of coercion and cruelty done with her. Further submission is that in view of the statement of the victim given before the Magistrate a strong prima facie case for bail in favour of the applicant is made out. Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed forth before the Court. The circumstances which, according to the counsel, led to the false implication of the accused have also been touched upon at length. It has been assured on behalf of the applicant that he is ready to cooperate with the process of law and shall faithfully make himself available before the court whenever required. It has also been submitted that the applicant is languishing in jail since 15th September, 2017 and in the wake of heavy pendency of cases in the Court, there is no likelihood of any early conclusion of trial.
