Learned counsel for the applicant in support of his application for bail submits that the applicant is innocent. He has been falsely implicated. It is further submitted that the belated FIR was registered by the victim herself under sections 376, 511, 323, 504, 506 IPC against the sole accused Rashid, the applicant. The police after investigation has submitted a final report in the aforesaid case on 08.01.2016 of which the protest petition was filed by the victim on 04.11.2015. The aforesaid protest petition is still pending before the competent court concern. Thereafter, on the same facts and circumstances on 04.11.2015 an application u/s 156(3) was moved which was treated as complaint case. On 02.02.2017 the applicant was summoned by IIIrd Additional Chief Judicial Magistrate, Saharanpur u/s 376, 511, 323, 305, 506 IPC. It is further submitted that as per medical report there are 6 injuries over her person and all the injuries are caused by friction by hard and blunt object, which are simple in nature. She is aged about 22 years. It is further submitted that the prosecutrix is married with one Khalid on 20.03.2015 but due to certain reasons there were no 'Issues' between them and that was the root cause of strained relationship between the husband and wife. It is next submitted that the applicant who is Jeth of the victim, is in jail since 19.03.2018 having no criminal antecedents except the present one, has been falsely named in the offence of 'attempt to rape.'
