Heard learned counsel for the applicant as well as the learned AGA for the State and perused the material placed on record.

This is the second bail application.

The instant bail application has been filed on behalf of the applicant, Ram with a prayer to release him on bail in Case Crime No. 179 of 2016, under Sections 307, 504 IPC, Police Station Kharkhauda, District- Meerut, during pendency of trial.

It is argued by the learned counsel for the applicant that the applicant is absolutely innocent and has been falsely implicated in the present case with some ulterior motive.The argument is that P.W.1 and P.W.2 namely, Harishpal and Kamal Singh, who are sons of the injured have stated in their statements before the court below,that it was co-accused Tarun, who fired and caused injury to their father by country made pistol. No allegation has been made against the applicant for firing at the injured. The applicant is languishing in jail since 22.4.2016, who is not a previous convict. In case, the applicant is released on bail, he will not misuse the liberty of bail.
