Learned counsel for the applicant in support of her prayer for bail submits that the applicant is innocent and she has been falsely implicated in the present case due to ulterior motive and she has committed no offence. It is next contended that there is no public or independent witness to support the prosecution version and nothing incriminating has been recovered from the possession of the applicant The applicant is only the Office Assistant and the co-accused Nishant Arora, who was the manger of Earth Infrastructure Limited EIOS 113, Sector 71 Gurgaon, Hariyana, has already been granted bail by this Court vide order dated 15.12.2017 passed in Criminal Misc. Bail Application No.49347 of 2017, copy whereof has been placed on record. It is further submitted that since the co-accused has already been granted bail, the accused-applicant is also entitled for bail on the ground of parity. The applicant is a lady having a child on her lap. The applicant is having criminal history of one case, which has been explained. The applicant has also been granted bail by Coordinate Bench of this Court on 20.12.2017, copy of which is annexed as annexure-5 on pages 45 to 56 and in case the applicant is being released on bail, she will not misuse the liberty of bail. The applicant is in jail since 18.11.2017. Several other submissions in order to demonstrate the falsity of the allegations made against the applicant have also been placed forth before the Court. The circumstances which, according to the counsel, led to the false implication of the accused has also been touched upon at length. It has been assured on behalf of the applicant that she is ready to cooperate with the process of law and shall faithfully make himself available before the court whenever required.
