Heard learned counsel for the applicant and learned A.G.A. in opposition.

This application under Section 482 Cr.P.C. has been filed to quash the impugned charge sheet dated 31.5.1999 in Case No.981/9 of 2000 arising out of Case Crime No.131 of 1999, under Sections 323, 504, 506 IPC, Police Station Civil Line, District Muzaffar Nagar, pending in the court of ACJM courtno.2, Muzaffar Nagar.

Learned counsel for the applicant has engaged attention of this Court on Annexure No.6 to the application, which is the a photo state copy of compromise deed between the parties, whereby it has been claimed that dispute between both of them has been amicably resolved and in regard thereto they do not want to proceed further with the lis.

Learned A.G.A. could not dispute the aforesaid facts.

Since the sections involves in this case are compoundable one, therefore, lower court shall decide the compromise application (Annexure no.6) within a period of one month from the date of production of certified copy of this order in accordance with law.

For a period of thirty days from today, no

coercive action shall be taken against the applicant.

¶12

However, in the event no such application is moved within the time prescribed above, this order will be of no avail to the applicant.

With the above direction, the instant application under Section 482 Cr.P.C. is finally disposed of.
