Heard Sri Shibli Naseem, learned counsel for the applicants and learned A.G.A. for the State and perused the record.
This application under Section 482 Cr.P.C. has been filed with a prayer to direct the Principal Judge, Family Court, Jaunpur to decide the interim maintenance application filed by the applicants before the court below on 8.11.2017 in case no. 352 of 2008 (Narjis Fatma and others Vs. Dilshad Hussain @ Fariyad Hussain) under Section 125 Cr.P.C., Police Station Sari Khwaja, District Jaunpur within time fame fixed by this Court.
From the record in question, this Court find that the order sheet maintained before the Family Court is not at all before this Court so that this Court can come to know as to in what way and manner the case has proceeded and who has proceeded to contribute to delay the proceedings in question.
In view of this, this application under 482 Cr.P.C., is dismissed . However, dismissal of this application will not at all come in the way of Principal Judge, Family Court, Jaunpur to deal with the matter and decide the same in accordance with law without granting unnecessary adjournment to either of the parties.
