Heard learned counsel for the applicant, learned A.G.A. for the State of U.P. and perused the record.

This application under Section 482 Cr.P.C. has been filed on behalf of the applicant with a prayer to quash the entire proceedings of Complaint Case No. 170 of 2017 (Santosh Shahu v. Sanjiv Chandan) under Section 138 of the Negotiable Instruments Act, 1881 Police Station - Baberu, District - Banda as well as the summoning order dated 07.11.2017 passed by Special Judicial Magistrate-I, Banda pending in the court of Special Judicial MagistrateI, Banda.

Learned counsel for the applicant contended that no offence is made out against the applicant.

From the perusal of the impugned order, it cannot be said that no offence is made out against the applicant. However, learned counsel for the applicant submitted that the applicant is ready to pay the cheque amount to opposite party no. 2 - Santosh Kumar Shahu.

In view of above, the prayer for quashing the summoning order as well as entire proceeding in the aforesaid case is refused.

Let the matter be remitted to Mediation Centre, District Court Banda within 15 days from the receipt of certified copy of this order.

For a period of 60 days from today, no coercive action shall be taken against the applicant.

With the aforesaid direction, the instant application stands disposed of .
