This application has been preferred seeking quashing of proceedings relating to Criminal Complaint Case No. 44454 of 2017, Dr. Rajesh Gaur Vs. Deepak Medical and General Store, under Section 138 of the N.I. Act, Police Station Kakadev, District Kanpur Nagar pending in the court of M.M. 3rd, Kanpur Nagar.
The submission of the learned counsel has centered around the averments taken in paragraphs 10 and 11 of the Affidavit filed in support of the instant application. However, the Court notes that these and other disputed issues which are raised touch upon the defence which the applicant is likely to take. The same does not form a ground for quashing of proceedings in question.
The application is dismissed .
