This application under Section 482 Cr.P.C. has been filed for quashing the proceeding of Case No. 1232/9 of 2018, related to impugned charge sheet dated 03.10.2017 arising out of Case Crime No. 225 of 2017 under Sections 147, 148, 149, 354, 354(B), 323, 504 and 506 IPC, P.S. Falawda, District Meerut.
From a prima facie evaluation of the material placed on the record as well as the statement of the informant, the Court finds itself unable to conclude that the commission of offences is not prima facie made out.
Accordingly, the prayer for quashing proceeding of Case No. 1232/9 of 2018, related to impugned charge sheet dated 03.10.2017 arising out of Case Crime No. 225 of 2017 under Sections 147, 148, 149, 354, 354(B), 323, 504 and 506 IPC, P.S. Falawda, District Meerut is refused.
It is, however, observed that in case the applicants apply for bail, the same shall be considered by the concerned Court on its own merits in accordance with law and bearing in mind the decisions rendered by this Court as well as the Supreme Court on the subject of grant of bail.
The application is disposed of with the above observations.
