The present 482 Cr.P.C. application has been filed by the applicant for consideration of his bail application in accordance with law, arising out of Case Crime No. 158 of 1998, under Section 2, 3 U.P. Gangsters Act, P.S. Sadabad, District Hathras.
The argument advanced is that three cases have been shown in the gang chart, in two of which he has been acquitted, whereas, in the third one he could not make appearance. He himself admit that he came out of jail in 2004. The NBW was issued on 26.07.2013. No plausible explanation has been given as to why he has not cooperated in the trial and absented from the proceedings of Case No. 210 of 1999.
No case for interference is made out.
The application is dismissed.
