Heard learned AGA appearing for the State on the application seeking leave to appeal against the judgment and order dated 28.03.2018, by means of which, the accused-respondent No. 2 and 3 have been acquitted for offences under Sections 395 and 397 IPC by the Court below.
The appeal has been filed on the following grounds:-
"1. Because, the learned trial court has not properly appreciated the evidence produced by the prosecution and has discussed the case only on the basis of conjectures and surmises.
has been acquainted him on account suspicion of his presence at the place of alleged incident being two accused persons same title / name."
We have perused the aforesaid judgment which shows that the Trial Court has recorded categorical findings after considering the entire evidence on record.The findings of the Court concerned shows that the Court concerned has given cogent reasons while acquitting the accused-respondents. The court concerned has concluded herein as below:-
"ललेककिन ससाथ हही यहहीं पर स्पष्ट रुप सले कदिखसायही पड़तसा हहै ककि अकभिययक्तगण दसारसा आगलेयसास्त्र किसा लले जसानसा ससाकहीगण नले अपनले बयसान मम ततो किहसा हहै ललेककिन घटनसा क्रम मम ककिसही भिही आगलेयसास्त्र किसा प्रयतोग हतोनसा ककिसही भिही ससाकही किले बयसान मम नहहीं आयसा हहै और न हही आगलेयसास्त्र सले वसादिही पक किसा कितोई व्यकक्त हही घसायल हहआ हहै अथसार्थात आगलेयसास्त्र किकी कितोई चतोट नहहीं हहै। ऐसले मम मम इस मत किसा ह ह ककि धसारसा 395/397 भिसा0 दि 0 सस0 किसा अपरसाध अकभिययक्तगण किले खखलसाफ ततो ससाकबत नहहीं हतोतसा हहै, ललेककिन किच्चही दिहीवसार सले लतोहले किसा फसाटकि अकभिययक्तगण दसारसा लले जसानसा सभिही ससाकहीगण किले सशपथ बयसान मम ससामसान रुप सले आयसा हहै। ससाथ हही अपनले धसारसा 313 दि 0 प्र 0 सस0 किले बयसान मम अकभिययक्त वलेदिप्रकिसाश नले अकभियतोजन ससाकहीगण दसारसा झझूठही गवसाहही दिलेनले किकी बसाबत बतसायसा हहै और किहसा हहै ककि अकभियतोजन ससाकहीगण वसादिही किले ररश्तलेदिसार हम। वसादिही दसारसा झझूठसा फसससायले जसानले किसा किथन किरतले हहए सफसाई मम तमसाम दिस्तसावलेजही ससाक्ष्य दिसाखखल ककियले गयले हहै, खजनकिसा मलेरले दसारसा सम्यकि अवलतोकिन ककियसा गयसा। ललेककिन बचसाव पक दसारसा दिसाखखल ककिसही भिही दिस्तसावलेज सले अकभिययक्त कितो लसाभि हसाखसल नहहीं हतोतसा हहै। ससाथ हही पतसावलही किले सभिही औपचसाररकि प्रपत यथसा नक्शसा नजरही, आरतोप पत आकदि किकी औपचसाररकि सत्यतसा कितो अकभियतोजन पक दसारसा औपचसाररकि ससाकही पही0 डब्लझू0 4 कवश्वनसाथ खससह दसारसा अपनले सशपथ बयसान सले बखझूबही ससाकबत ककियसा गयसा हहै।
इस प्रकिसार उपरतोक्त किकी गई चचसार्था एवस कवश्ललेषण किले आधसार पर मम इस कनष्किषर्था पर पहहसचतसा ह ह ककि अकभिययक्तगण दसारसा वसादिही किसा फसाटकि चयरसाकिर लले जसानसा गवसाहसान नले अपनले सशपथ बयसान मम सपष्टरुप सले किहसा हहै। अकभिययक्तगण वसादिही किसा लतोहले किसा फसाटकि उतसारकिर लले गयले और धझूरसा भिही ढकिलेल मम लसादिकिर लले गयले। अततः स्पष्ट हहै ककि कववसाकदित भिझूकम जतो घटनसा किले समय वसादिही पक किले किब्जले मम थही उसमम दिहीवसार मम लगले लतोहले किले फसाटकि कितो अकभिययक्तगण चयरसाकिर लले गयले। ऐसले मम अकभिययक्त वलेदिप्रकिसाश किले कवरुद्ध अकभियतोजन पक दसारसा 380
भिसा0 दि 0 सस0 सन्दिलेह सले परले ससाकबत किरनले मम पझूणर्थातयसा सफल रहसा हहै। अततः अकभिययक्त वलेदिप्रकिसाश धसारसा 380 भिसा0 दि 0 स 0 किले तहत दितोषखसद्ध ककियले जसानले यतोग्य हहै।"
In view of the aforesaid facts and circumstances of the case, it cannot be said that the view taken by the Court below is not possible and plausible thus the judgment of the court below cannot be interfered with by this Court only on account of the fact that another view is possible.
Learned A.G.A. has not been able to point out any illegality or perversity with the findings as recorded by the court below and thus it cannot be said that the view taken by trial court is a perverse view.
Thus in view of aforesaid consistent legal position as elaborated above and also in view of the fact that learned A.G.A. has failed to point out any illegality or perversity with the findings so recorded in the impugned order, no case for interference has been made out. No interference with the impugned judgment and order of acquittal is warranted. Accordingly the application seeking leave to appeal is rejected. Consequently, appeal is also dismissed.
Let a copy of this order be certified to the court concerned for necessary compliance.
