Learned counsel for the petitioner prays for and is permitted to delete the prayer no. (i) from the main prayer of the petition.
Only prayer made during the course of argument is to issue a direction to the Court below to decide the objection dated 3.11.2018 filed by the petitioner in execution case no. 45 of 2016 (Shree Ram Transport Company vs. Dharmendra Singh and another).
A perusal of the order-sheet indicates that the matter is pending for disposal of objection filed by the petitioner/opposite party no. 2. The date fixed in the matter is 6.1.2019.
Noticing the said fact from the order-sheet, the present petition is being disposed of with the direction to the executing court to decide the application/objection filed by the petitioner as noted hereinabove on the next date fixed or on a short date to be fixed within a further period of two weeks, thereafter.
